By using the voomy platform, the user confirms that they have read these Terms and accept them in full. ## 1. Terms [#1-terms] The following definitions are used for the purposes of these Terms: voomy means an online platform designed for publishing, viewing, and distributing digital content, user interaction, and the use of paid subscriptions. User means any person who uses the voomy platform. Creator means a user who publishes content on the platform. Content means any materials posted on the platform, including videos, images, text materials, playlists, and other items. Subscription means a paid or free tier of access to a creator's content. ## 2. Subject of the Terms [#2-subject-of-the-terms] The Platform provides users with access to the features of the voomy service subject to these Terms. Depending on the features available, the platform may be used either without registration or after an account has been created. ## 3. Registration and account [#3-registration-and-account] To use certain platform features, the user must create an account. The user agrees to: * provide accurate information; * keep their information up to date; * ensure the security of their account; * not give third parties access to the account. The user is responsible for all actions taken through their account. ## 4. Use of the platform [#4-use-of-the-platform] The user may: * view content; * purchase subscriptions; * interact with creators; * use other platform features for their intended purpose. The user must comply with these Terms, the Community Guidelines, and legal requirements. ## 5. User content [#5-user-content] Creators bear sole responsibility for the content they publish. By posting content on the platform, the user confirms that they have the necessary rights and permissions to use it. The user warrants that publishing the content does not infringe the rights of third parties. ## 6. Intellectual property [#6-intellectual-property] Rights to content posted by users remain with the relevant rightsholders. By posting content on the platform, the user grants voomy the non-exclusive right to store, process, display, and distribute that content as part of the operation of the platform. Rights to the platform's software, design, logos, and other elements belong to voomy or are used on a lawful basis. ## 7. Subscriptions and paid content [#7-subscriptions-and-paid-content] The platform enables users to purchase paid subscriptions to creators. Subscription prices are set by creators or by the platform, depending on the particular feature. The user independently decides whether to purchase a subscription. Paid access is provided to the extent defined by the creator of the relevant subscription tier. ## 8. Payments [#8-payments] All payments are made through the available payment services. The platform does not store users' bank card details unless the payment solution being used provides otherwise. Refunds are governed by applicable law, the terms of payment services, and the platform's internal rules. ## 9. Restrictions on use [#9-restrictions-on-use] The user may not: * violate the law; * distribute malicious software; * use the platform for fraudulent purposes; * obtain unauthorized access to platform systems; * interfere with the operation of the service; * use automated means to circumvent platform restrictions; * infringe the rights of third parties. ## 10. Content moderation [#10-content-moderation] The platform may moderate content and user activity. The administration may: * remove content; * restrict access to certain features; * temporarily or permanently suspend accounts; * take other measures necessary to ensure the security of the platform and its users. ## 11. Complaints and requests [#11-complaints-and-requests] The user may submit complaints about content or the actions of other users through the tools provided by the platform. The administration reviews requests within a reasonable period and may ask for additional information. ## 12. Platform availability [#12-platform-availability] voomy strives to keep the service operating reliably but does not guarantee uninterrupted or error-free operation of the platform. The platform may perform maintenance, updates, and feature changes without notifying users in advance. ## 13. Limitation of liability [#13-limitation-of-liability] The platform is not the creator of user content and is not responsible for its content. The platform does not guarantee: * that content will meet the user's expectations; * any particular result from using the service; * the absence of errors or service interruptions. To the fullest extent permitted by law, the platform's liability is limited to the amount actually paid by the user during the last 12 months of using the service. ## 14. Suspension and termination of access [#14-suspension-and-termination-of-access] The administration may restrict or terminate a user's access to the platform in the event of: * violation of these Terms; * violation of the Community Guidelines; * violation of the law; * a threat to the security of the platform or its users. ## 15. Changes to the service [#15-changes-to-the-service] The platform may change the service's features, interface, capabilities, and terms of use at its discretion. Individual features may be added, changed, or discontinued without prior notice. ## 16. Changes to the Terms [#16-changes-to-the-terms] voomy may amend these Terms at any time. A new version takes effect when it is published on the platform unless otherwise stated. Continued use of the platform after changes take effect constitutes the user's acceptance of the new version of the Terms. ## 17. Final provisions [#17-final-provisions] If any provision of these Terms is found to be invalid, the remaining provisions shall continue in full force and effect.
